Terms & Conditions
1. Quotes & Scope of Work
All quotations are valid for 30 days from the date of issue unless otherwise stated.
Quotations are prepared based on the information available at the time of the site visit and the agreed scope of work. If the scope changes before or during works - due to client requests, unforeseen site conditions, or factors not reasonably identifiable at the time of quoting - the quotation will be revised. Any changes to scope or cost will be discussed and agreed in writing before work proceeds.
Once a quotation is accepted, no changes can be made without written agreement from both parties.
Where jobs are booked more than 60 days after quote acceptance, material or supplier price increases may apply. You will be notified of any changes before work is scheduled.
Where materials or supplies cannot be sourced from our primary suppliers, we will requote the affected items using an alternative supplier. Any pricing changes will be communicated and agreed with you before work proceeds.
2. Deposits & Payment
All projects are invoiced in three stages:
40% due upon quote acceptance to secure your booking and cover the purchase of materials
30% due at the agreed project midpoint or upon completion of a nominated milestone
30% due upon completion of all agreed works
The first payment must be received before work is scheduled and materials are ordered. Payments are non-refundable where materials have been purchased or subcontractors have been engaged for your project.
Payment is due within 7 days of each invoice unless otherwise arranged in writing. Overdue accounts will incur a monthly account-keeping fee of 2% of the outstanding balance.
3. Scheduling & Project Timelines
Upon accepting your quote, you will be offered our next available start date. If you require a specific date, we will confirm availability and do our best to accommodate the request.
Project schedules are prepared in advance and shared with you before work begins. These timelines are indicative and may be subject to change due to factors including:
Weather conditions that make it unsafe or impractical to work
Delays in material or product supply
Trade or subcontractor availability
Site conditions that differ from those identified at the time of quoting
Council approvals, permits, or other regulatory requirements
Where delays occur, we will communicate with you as early as possible and provide a revised timeline. We will always aim to minimise disruption and keep your project moving.
Clients may cancel a scheduled job at any time without penalty, provided materials have not been ordered and work has not commenced. Where materials have been purchased or subcontractors have been engaged, cancellation costs may apply.
4. Site Conditions & Unforeseen Works
Our quotations are based on site conditions as observed during the initial site visit. If ground or site conditions are materially different from what could reasonably have been anticipated - including rock, tree roots, poor soil, drainage issues, or subsurface obstructions - additional labour, machinery, or materials may be required.
Any additional costs arising from unforeseen conditions will be identified, explained, and agreed with you in writing before work continues.
5. Client Responsibilities
To allow us to carry out works safely and efficiently, clients are responsible for:
Ensuring clear and safe access to the work site on agreed days
Providing access keys, gate codes, or arranging access to relevant areas
Notifying neighbours or relevant stakeholders where required
Obtaining any council permits, body corporate approvals, or authority permissions necessary for the works
Disclosing all known site hazards, including underground services, irrigation lines, lighting cables, drainage infrastructure, and any brittle or sensitive surfaces
Contacting Dial Before You Dig where excavation or earthworks are planned
If work is delayed or interrupted due to access issues, missing permits, or undisclosed site conditions, additional charges may apply.
6. Safety
Clients must ensure that all persons - including residents, tenants, children, and pets - remain clear of the work area at all times during works. Bunbury Landscapes reserves the right to stop work if site conditions become unsafe. Where work is halted due to unsafe conditions or unauthorised access, additional charges may apply.
7. Subcontractors
Bunbury Landscapes coordinates and oversees a network of trusted local subcontractors and specialist trades as part of project delivery. All subcontractors engaged by Bunbury Landscapes are managed under our supervision and are expected to meet our standards for quality and conduct.
8. Liability
Bunbury Landscapes holds full Public Liability insurance. A copy of our Certificate of Currency is available upon request following quote acceptance.
We are not liable for damage to underground or surface infrastructure not identified or disclosed by the client prior to works commencing. This includes but is not limited to:
Utility and service lines
Irrigation systems and lighting cables
Sewerage and stormwater infrastructure
Paving, driveways, kerbs, and soak wells
Fencing, edging, and decorative or brittle surfaces
All reasonable care is taken during works. We are not liable for incidental surface marks, scuffing, or friction caused by tools, machinery, or materials as a result of the nature of the work.
Bunbury Landscapes is not liable for indirect, incidental, or consequential damages. Where legally required, our liability is limited to resupplying the services or covering the reasonable cost of doing so.
9. Delays Beyond Our Control
In the event of circumstances beyond our reasonable control - including severe weather, natural events, supply chain disruptions, or other force majeure events - we will make all reasonable efforts to complete your project but cannot guarantee specific delivery dates. We will communicate any such delays promptly and work with you on a revised schedule.
10. Follow-Up & Defects
Our pricing includes reasonable follow-up within 14 days of project completion. This covers final site checks and minor rectification of any items identified as incomplete or defective.
Claims regarding damage or defective work must be submitted in writing within 48 hours of project completion. Claims received outside this timeframe may not be accepted. Requests for additional work beyond the agreed scope will be quoted separately.
11. Property Managers & Corporate Clients
Quote acceptances from property management companies or corporate clients must be submitted on company letterhead or via a verified email from an authorised representative.
We will not action requests from tenants or site contacts without prior written authorisation from the Property Manager or nominated company representative. Once authorised, we will liaise directly with the tenant or site contact to coordinate access and carry out works.
For large or multi-tenancy sites where no representative will be present during quoting, please provide a site map or marked-up plan indicating the area for inspection.
12. General
These Terms and Conditions are governed by the laws of Western Australia and comply with the Australian Consumer Law.
Any changes to these Terms and Conditions must be agreed in writing by an authorised representative of Bunbury Landscapes. Clients acknowledge that they have not relied on any verbal representation outside of what is stated in this agreement.
